Bateleur Festival Participation Regulations 2025

1. General

  • 1.1 The Bateleur Festival 2025 (hereinafter: the “Festival”) is a four-day event scheduled to take place from October 23, 2025, to October 26, 2025 (hereinafter: the “Event Period”).

  • 1.2 The Festival is expected to be held at the "Elounda Bay Palace Hotel", located in the city of Crete, Greece (hereinafter: the “Hotel”).

  • 1.3 The Festival will include various wellness workshops such as yoga, ice baths, crystal healing, and more, alongside diverse parties and performances (hereinafter: the “Activities”).

  • 1.4 The Festival is produced by A.G.N. Kinley Productions Ltd., C.N. 516750650 (hereinafter: the “Organizer”).

  • 1.5 The Organizer permits individuals to register, purchase tickets, and participate in the festival (hereinafter: the “Offered Services”) subject to the terms and conditions of these regulations (hereinafter: the “Terms”).

  • 1.6 Participants are those who purchase the Offered Services (hereinafter: the “Participant(s)”).

  • 1.7 These Terms regulate the legal relationship between the Organizer and the Participants.

  • 1.8 By purchasing the Offered Services, the Participant affirms that they have read, understood, and agreed to be bound by these Terms. If the Participant does not agree to any part of the Terms, they must refrain from purchasing the Offered Services.

  • 1.9 The Participant further acknowledges that the Organizer has drawn their attention to the availability of these Terms on the landing page of the website at www.bateleur-festival.com. Even if they have not read the Terms, their voluntary decision not to do so does not exempt them from compliance.

  • 1.10 The Participant waives any claim and/or demand and/or suit regarding lack of knowledge of these Terms (or part thereof) and understands that the Organizer would not have accepted them as a Participant without their agreement to the Terms.

  • 1.11 The Organizer and/or its representatives shall not be liable for any direct, indirect, consequential, or special damages (including loss of income and/or profits) caused to Participants acting contrary to the Terms.

  • 1.12 The Organizer may, from time to time and at its sole discretion, amend these Terms for any reason without prior notice. The latest published Terms shall be binding and apply to all Participants.

  • 1.13 In case of any contradiction between these Terms and any other form of publication or information (including media content), these Terms shall prevail.

  • 1.14 The Organizer reserves the right, at its sole discretion, to deny any Participant from purchasing the Offered Services who is or is suspected of being in violation of these Terms and/or acts in a way that may harm the Organizer’s reputation.

  • 1.15 The Organizer reserves the right to change, extend, shorten, cancel, or postpone the Festival at any time and for any reason, including but not limited to: insufficient number of participants, force majeure, war or threats of war, military or security operations, lockdowns, civil unrest, extreme weather, fires, flooding, pandemics, flight schedule changes (including but not limited to cancellations and delays), safety engineer instructions, or other reasons beyond the Organizer’s control. Participants waive any claim and/or demand and/or suit in this regard. In case of cancellation, Participants will be entitled to a refund according to applicable law, but shall bear sole responsibility for any other resulting damage.

  • The Offered Services

  • 2.1 The purchase of the Offered Services shall be subject to availability only.

  • 2.2 The Offered Services may be purchased only by Participants who declare that they are over the age of 24, and only if they possess a private Instagram and/or Facebook account. It is hereby clarified that entry to the Festival will not be permitted for Participants under the age of 24, and each Participant will be required to present identification upon arrival proving their age. A Participant who declared that they are over 24 but is in fact under that age shall not be permitted entry and shall not be entitled to any refund for the purchase of the Offered Services.

  • 2.3 The purchase of the Offered Services shall be made by submitting personal details (including but not limited to full name, email address, private Instagram and/or Facebook profile, ID or passport number, and phone number) on the landing page at www.bateleur-festival.com.

  • 2.4 After submitting details, the Organizer or its representatives will contact applicants by phone based on the order of submissions and at the sole discretion of the Organizer. Applicants will be required to provide a credit card number and/or proof of a bank transfer (“the Payment”).

  • 2.5 The purchase of the Offered Services shall only be completed and confirmed upon receipt of proof of payment from the Organizer, and only after the Participant has fully paid the Payment (“the Booking”). The Organizer reserves all rights under these Terms even after issuing proof of purchase.

  • 2.6 Without derogating from the above, the Organizer and/or its representatives may prevent any applicant or Participant from purchasing the Offered Services, temporarily or permanently, in any of the following cases:

  • 2.6.1 If the Organizer or its representatives believe that the Participant deliberately provided false or incorrect information. It is clarified that submitting false purchasing information is a criminal offense, and the Organizer and/or its representatives shall be entitled to take all legal measures against the individual, including legal proceedings for damages caused or that may be caused.

  • 2.6.2 If the Organizer or its representatives believe that the Participant committed an act or omission that harms or may harm the Organizer and/or its representatives and/or any third party.

  • 2.6.3 If the Organizer or its representatives believe that the Participant made illegal use of the landing page or facilitated, enabled, or encouraged such use.

  • 2.6.4 If the credit card provided by the Participant has been blocked or restricted.

  • 2.6.5 If the Organizer or its representatives believe that the Participant violated these Terms or any applicable law.

  • 2.7 The applicant or Participant declares that they are a private individual purchasing the Offered Services for personal use and not for the purpose of resale (“Prohibited Purchase”). Any such Prohibited Purchase shall entitle the Organizer and/or its representatives to take any legal action against that Participant.

  • 2.8 There are three packages available for purchasing the Offered Services:

  • 2.8.1 Full Package:

  • 2.8.1.1    Displayed on the landing page at www.bateleur-festival.com. This package includes accommodation at the Hotel with breakfast, round-trip economy-class flights from Israel (Ben Gurion Airport) to Heraklion, Crete, with up to 20 kg of checked luggage and 7 kg of hand luggage, transfers to and from the airport, and participation in all Activities as defined in Section 1.3.

  • 2.8.1.2    As part of the Festival organization, the Organizer has chartered a flight for    Participants who purchased the Full Package. These Participants acknowledge that flight tickets will be sent by email up to 24 hours prior to the beginning of the Event Period.

  • 2.8.1.3   The Organizer’s representative(s) will meet these Participants at Ben Gurion Airport at   the terminal specified on the flight tickets and accompany them to the Hotel and back    after the Festival.

  • 2.8.2 Package without Flights:

  • Information available by phone as detailed in Section 9.1 below. This package includes accommodation at the Hotel with breakfast but does not include flights or transfers. The Participant is solely and fully responsible for arranging and paying for flights and transfers.

  • 2.8.3 One-Day Entry Ticket:

  • Information available by phone as detailed in Section 9.1 below. This package includes one-day admission to the Festival and participation in the Activities on that day, according to the schedule set by the Organizer and at its sole discretion.

  • 2.9 As part of the Activities, wellness workshops will be held, as noted in Section 1.3 above (each such workshop: “Workshop”). Participation in any Workshop is conditional upon compliance with the following instructions:

  • 2.9.1 Participation must be in proper attire and sports shoes (except in sessions designated to be barefoot by the Workshop team);

  • 2.9.2 No use of equipment or facilities is permitted without prior instruction from the Workshop staff;

  • 2.9.3 Participants must use equipment and facilities appropriately, only for their intended purposes, and without causing damage;

  • 2.9.4 Participants must follow all instructions and guidelines provided by the Workshop staff;

  • 2.9.5 Participation is not permitted under the influence of alcohol, drugs, or sedatives;

  • 2.9.6 Participation may be subject to completing a health declaration in a form provided by the Organizer. In case of any change in the Participant’s medical condition, the Participant is required to notify the Workshop staff.

  • It is clarified that failure to comply with the above instructions may result in denial of participation in the Workshop, even after it has begun.

  •  

  • 3. The Booking

  • 3.1 The Booking entitles the Participant to participate in Activities on a space-available basis only. To participate in Activities (excluding parties), Participants must pre-register 24 hours prior to the start of the Event Period. It is clarified that each Participant must inform the Organizer at the time of registration for the Activity if they have any limitations – medical, physical, or psychological.

  • 3.2 Room check-in at the Hotel (“Check-in”) will take place on the Festival arrival date, October 23, 2025, starting from 15:00, subject to room readiness by the Hotel. Room check-out (“Check-out”) will take place on the final day of the Festival, October 26, 2025, no later than 11:00. A Participant who fails to check out by this time may be charged an additional fee by the Hotel and/or by the Organizer and/or their representatives. It is the sole responsibility of the Participant to confirm the exact Check-in and Check-out times as determined by the Hotel from time to time.

  • 3.3 The Organizer cannot guarantee early check-in or late check-out for any reason. Any such request must be made directly to the Hotel, which may charge an additional fee for early check-in and/or late check-out.

  • 3.4 The Participant undertakes to respect all Festival rules and regulations, to treat other Participants with respect, to act with sensitivity toward others and themselves, and to strictly comply with the instructions of the Organizer, ushers, the production staff, and security personnel before, during, and after the Festival.

4. Cancellation of Booking and Cancellation Fees

4.1 These Terms are subject to the provisions of applicable law. In any case of contradiction and/or inconsistency between the provisions of these Terms and the provisions of the law, the provisions of the law shall prevail.

4.2 Booking cancellation shall be executed by sending a cancellation notice to the Organizer (hereinafter: the "Cancellation Notice") using one of the following methods:

4.2.1 Telephone call and/or SMS message to the Organizer’s representative at +972-52-3514925, Sunday through Thursday, between 09:30 and 16:00.

4.2.2 Email to: bateleur.co@gmail.com

A Participant wishing to cancel a booking must include their full name and identification number in the Cancellation Notice.

4. Cancellation of Booking and Cancellation Fees

4.1 These Terms are subject to the provisions of applicable law. In any case of contradiction and/or inconsistency between the provisions of these Terms and the provisions of the law, the provisions of the law shall prevail.

4.2 Booking cancellation shall be executed by sending a cancellation notice to the Organizer (hereinafter: the "Cancellation Notice") using one of the following methods:

4.2.1 Telephone call and/or SMS message to the Organizer’s representative at +972-52-3514925, Sunday through Thursday, between 09:30 and 16:00.

4.2.2 Email to: bateleur.co@gmail.com

A Participant wishing to cancel a booking must include their full name and identification number in the Cancellation Notice.

4.3 Cancellation Fees

4.3.1 From the booking date or the date of receiving confirmation of the booking (hereinafter: the “Booking Date”) and for 14 days thereafter, provided that the Cancellation Notice is received by the Organizer no later than 7 business days prior to the start of the Event Period – the Participant may cancel the booking. In such a case, the Organizer may charge cancellation fees not exceeding 5% of the amount paid or 100 NIS, whichever is lower.

4.3.2 From the 15th day following the Booking Date, and provided that the Cancellation Notice is received by the Organizer no later than October 1, 2025 (inclusive) – the Participant may cancel the booking. In such a case, the Organizer may charge cancellation fees not exceeding 5% of the amount paid or 100 NIS, whichever is lower.

4.3.3 From the 15th day following the Booking Date, and provided that the Cancellation Notice is received by the Organizer between October 2, 2025 (inclusive) and October 12, 2025 (inclusive), the Participant may cancel the booking. In such a case, the Organizer may charge cancellation fees amounting to 50% of the amount paid.

4.3.4 From the 15th day following the Booking Date, and provided that the Cancellation Notice is received by the Organizer on or after October 13, 2025 (inclusive), the Participant shall not be entitled to cancel the booking and shall not receive a refund, whether or not they informed the Organizer of their intention not to attend the Festival.

4.3.5 Notwithstanding the foregoing and without derogating therefrom, if a Participant submits a Cancellation Notice due to the death and/or a medical emergency affecting themselves and/or their spouse and/or one of their parents and/or one of their children and/or one of their grandchildren and/or one of their siblings, and/or due to receiving a “Tzav 8” emergency military draft order issued in their name, and subject to presenting appropriate documentation evidencing the same – the booking shall be canceled and the Organizer may charge cancellation fees not exceeding 5% of the amount paid or 100 NIS, whichever is lower.

4.4 In circumstances where the Participant qualifies under one of the categories listed in Section 14C1 of the Israeli Consumer Protection Law, 1981, the cancellation conditions set forth in the law shall apply.

4.5 If the Cancellation Notice is approved by the Organizer and in accordance with this section, the refund shall be issued using the same method by which payment was made (a credit to the credit card used by the Participant or a bank transfer to the account from which payment was made), no later than 14 days from receipt of the Cancellation Notice, subject to applicable law.

 

  • 5. Limitation of Liability

  • 5.1 Participants acknowledge that changes may occur in the Activities and that the Organizer has the sole discretion to determine the schedule of Activities.

  • 5.2 The Organizer and/or its representatives may, at any time, for any reason, and at their sole discretion, change the Festival’s program, the Hotel, the flights, the Activities, the events, or any other product and/or service conducted and/or provided during the Festival, whether by the Organizer or by a third party.

  • 5.3 A Participant shall bear full responsibility for any damage of any kind, whether direct, indirect, consequential, or otherwise, caused to any third party during the Event Period, including during the Festival, flights, or stay at the Hotel, resulting from any act or omission on their part. This includes, but is not limited to, any damage caused to the Hotel room where the Participant is staying. The Participant agrees to indemnify the Organizer and/or its representatives upon first demand.

  • 5.4 The Participant agrees that any defect and/or delay and/or disruption or any similar occurrence in the Festival’s operation — including, without limitation, those caused by force majeure or events beyond the Organizer’s control — shall not constitute a breach of these Terms and shall not entitle the Participant to any relief or compensation, except as explicitly set forth herein.

  • 5.5 The Organizer may terminate the Festival at any time, for any reason it deems appropriate under the circumstances, or may cancel it or make changes to it. Participants shall have no claim, demand, or lawsuit in connection therewith.

  • 5.6 Participation in the Festival, or any part thereof, is at the sole responsibility of the Participants. The Organizer and/or its representatives shall not be liable for any damage incurred or to be incurred by Participants as a result of, or in connection with, their participation.

  • 5.7 The Organizer and/or its representatives shall not be liable for any loss, theft, wear, damage, or destruction of property or valuables of any kind during the Festival. The responsibility for safeguarding personal belongings and equipment lies solely with the Participants.

  • Code of Conduct

  • 6.1 The Organizer strives to ensure that the Festival is a safe environment, and therefore, the Organizer will enforce the following code of conduct.

  • 6.2 It is clarified that the Organizer reserves the right to conduct security checks through authorized security personnel at the Hotel entrance and Festival premises. A strict prohibition exists on bringing fire, weapons, glass items, sharp objects, knives, animals, drugs, and alcohol (including, but not limited to, alcohol purchased at duty-free shops), of any kind, into the Hotel and/or Festival premises (the “Prohibited Items”), as well as a strict prohibition on the use of such Prohibited Items. The Organizer and/or its representatives are entitled to remove any Participant who violates this provision from the Hotel and/or the Festival (or any part thereof).

  • 6.3 Participants must comply with the instructions of the Hotel staff, including the lifeguard at the pool, the Organizer, the ushers, and the security personnel throughout the Event Period. It is clarified that Participants who do not comply with these instructions may be removed from the Hotel and/or the Festival (or any part thereof).

  • 6.4 Participants must be aware that transportation and meal schedules are strict. Any Participant who does not arrive on time for transportation and/or meals will be required to make their own arrangements and bear the associated costs, with no entitlement to a refund.

  • 6.5 The Organizer takes any form of violence, whether physical or verbal, very seriously, as well as any form of sexual harassment toward other Participants, the Organizer’s representatives, Hotel staff, or any other individuals. It is the Participants' responsibility to report any incident of violence and/or sexual harassment to the Organizer.

  • 6.6 The Organizer and/or its representatives are entitled to immediately report to local authorities any Participant who violates the rules of conduct as outlined in this section, without prior notice, at their sole discretion.

  • 6.7 The Organizer reserves the right to remove any Participant who, in the Organizer's opinion or the opinion of its representatives, poses a risk to themselves, other Participants, or any other individuals, including, but not limited to, Participants under the influence of alcohol or drugs, those possessing or dealing with drugs, those previously banned from attending the Festival, or those acting in a way that disrupts the peace, incites violence, hatred, anger, etc., or endangers the safety of others, or refuses to undergo a security check by authorized personnel.

  • 6.8 It is further clarified that a Participant who violates the conduct rules as outlined in this section may be removed immediately or temporarily from the Hotel and/or the Festival at the Organizer's sole discretion, without any right to a refund or compensation, and without any claim or demand against the Organizer and/or its representatives in this regard.

  • 6.9 In addition, any Participant who violates the conduct rules as outlined in this section agrees to indemnify the Organizer and/or its representatives for any loss, expense, or damage of any kind (including legal fees) caused directly or indirectly by their actions.

  • Insurance Requirement

  • 7.1 The event is insured by the Organizer, but such insurance applies only to Participants who have independently purchased comprehensive personal travel insurance covering extraordinary events and/or adventure sports risks.

  • 7.2 Each Participant declares that they will obtain the aforementioned insurance for the duration of the Event Period and will carry proof of such insurance with them.

  • Advertising; Privacy

  • 8.1 Any matter relating to or concerning the advertising of the Festival, or any part thereof, or any other matter arising therefrom, shall be at the sole discretion of the Organizer, as determined from time to time.

  • 8.2 The Festival governed by these Terms may be covered by various media platforms and means of communication. Participants hereby irrevocably consent to such coverage and waive any claim and/or demand and/or suit in this regard, including any claim to moral rights.

  • 8.3 Participants acknowledge and agree that the Organizer may photograph and publish images of their participation in the Festival, including tagging them on social media, all at the Organizer’s sole discretion. Participants who do not agree with this provision are requested not to purchase the Offered Services.

  • 8.4 Participants consent to the Organizer collecting and storing information about them in the Organizer’s databases in connection with the purchase of the Offered Services. The term “Information” in this Section includes “sensitive information” as defined in the Privacy Protection Law, 1981, whether provided directly by Participants or obtained indirectly (including name, email address, phone number, purchase details, address, etc.). The purchase of the Offered Services constitutes the Participants’ consent to the Organizer’s use of such Information, including its modification, editing (including visual editing), statistical processing, and any other processing at the Organizer’s sole discretion, subject to applicable law. Participants are further aware that the Organizer may transfer Information about them outside the jurisdiction of Israel and/or the European Union, inter alia for cloud storage purposes, and they consent to such transfer.

  • 8.5 By purchasing the Offered Services and providing contact details, Participants consent to receive promotional messages and marketing materials from the Organizer regarding future events and related content via SMS, email, or other communication means. Participants may, at any time, request removal of their details and discontinue receipt of such messages.

  • 8.6 Participants understand and agree that the Organizer may forward credit card details provided by them to a payment processing company for the purpose of executing payment for the Festival.

  • 8.7 The Organizer undertakes to safeguard Information, not to trade, sell, or transfer such Information without Participants’ prior consent, except in the following cases:

  • to comply with legal requirements (including statutes, regulations, orders, directives, or official instructions);

  • in the event of a legal or business dispute between a Participant and the Organizer;

  • to respond to third-party claims;

  • to protect the rights or interests of the Organizer;

  • transfer of non-personally identifying statistical or browsing information to third parties;

  • transfer to third-party service providers related to Festival operation (such as payment processors, attorneys, accountants, business development consultants, mailing services for SMS and email campaigns);

  • in connection with a sale, merger, acquisition, or insolvency proceeding involving the Organizer.

  • 10. Miscellaneous

  • 10.1 If any provision of these Terms is held invalid, illegal, or unenforceable, such invalidity, illegality, or unenforceability shall not affect the validity of the remaining provisions of these Terms.

  • 10.2 The Organizer’s failure to exercise any right under these Terms or at law, in whole or in part, shall not constitute a waiver of such right, nor shall it create any precedent or estoppel for future acts.

  • 10.3 These Terms and any matter arising herefrom shall be governed exclusively by the laws of the State of Israel. The competent courts of Tel Aviv–Jaffa shall have sole jurisdiction to adjudicate any dispute.
